U.S. Senator Marco Rubio (R-FL) has voiced concerns over President Joe Biden's plans to restructure the Supreme Court, which include implementing term limits and an ethics code. The Washington Post reported on July 16 that Biden intends to endorse these changes, a plan he confirmed on July 29.
Rubio criticized the proposed reforms, suggesting they are driven by party politics rather than genuine need. He cited Laurence Tribe, a law professor who advised Biden, stating: "There is a compelling need for supreme court reform" due to what Tribe describes as an "imperial judiciary" favoring Donald Trump’s "Maga agenda."
Rubio dismissed this reasoning, pointing out recent unanimous and lopsided decisions by the Court that contradict the claim of bias towards Trump. He noted past efforts by high-ranking Democrats to reshape the Court when dissatisfied with its composition, referencing then-presidential candidate Kamala Harris's openness to expanding the body in early 2019.
In response to such proposals, Rubio introduced a constitutional amendment to limit the Supreme Court to nine Justices, arguing it was Congress's duty to "prevent the delegitimizing of the Supreme Court." He recalled Biden's own previous stance against court-packing: “No, I’m not prepared to go on and try to pack the court, because we’ll live to rue that day.”
Rubio urged President Biden to honor his call for unity and protect the integrity of one of America's most vital institutions.
