NOTICE OF INTENT TO CONSIDER A FIRST AMENDMENT 

TO DEVELOPMENT AGREEMENT PURSUANT TO CHAPTER 163, FLORIDA STATUTES

Notice is hereby given that on Thursday, March 23, 2023 beginning at 6:00 p.m., or as soon thereafter as possible, the City of Neptune Beach City Council will hold the first of two public hearings concerning a First Amendment to Development Agreement between the City of Neptune Beach, Florida and Neptune Beach, FL Realty LLC.

The hearing will take place in the City Council Chambers, 116 First Street, Neptune Beach, Florida 32266. All parties in interest and citizens may appear and be heard as to any and all matters pertinent to the proposed First Amendment to Development Agreement.

The proposed First Amendment to Development Agreement would allow the Developer and City to amend and modify certain provisions contained in the Development Agreement to include provisions related to water system improvements, enhanced vegetative buffer improvements, and return of escrow funds. The First Amendment to Development Agreement provides for recording in the public records and includes a waiver provision.

 A copy of the proposed First Amendment to Development Agreement may be inspected by the public in the office of the City Clerk, 116 First Street, Neptune Beach, Florida 32266, between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday, except holidays.

Please note that if any person decides to appeal any decision made by the City Council with respect to any matter considered at the meeting or hearing, they will need a record of the proceedings, and that, for such purpose, will need to ensure that a verbatim record of the proceedings in made, which record includes the testimony and evidence upon which the appeal is to be based.

In accordance with the Americans with Disabilities Act (“ADA”) and Section 286.26, Florida Statutes, persons with disabilities needing a reasonable accommodation to participate in this public hearing or meeting should contact the City Clerk’s Office no later than 5:00 p.m. the day of the meeting.
